1. Risk disclosure — CFTC Rule 4.41
Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, because the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown.
Trading futures, options on futures, foreign exchange and other leveraged derivative instruments carries a substantial risk of loss and is not suitable for every investor. Leverage magnifies both gains and losses. You may sustain a total loss of your initial margin and any additional funds deposited, and under certain market conditions you may lose more than the amount originally deposited. You should carefully consider whether such trading is appropriate for you in light of your financial condition, experience and risk tolerance.
Atlas is a software tool. It does not guarantee a profit, does not guarantee that losses will be limited, and does not guarantee that any proprietary-trading-firm evaluation, combine or funded-account objective will be passed or maintained. The risk controls it implements — position sizing, portfolio correlation ceilings, latched circuit breakers, prop rule gates — reduce the likelihood of specific identified failure modes. They cannot eliminate market risk, gap risk, liquidity risk, execution risk, counterparty risk or the risk of defects in the software itself.
Statistical and machine-learning components — including the regime classifier, evidence fusion, calibration mapping and second-stage filter — are estimated from historical and simulated data. Relationships estimated from the past may cease to hold at any time and without warning. Atlas measures its own predictive performance and stands down automatically when that performance degrades below a coin flip; this is a mitigation, not a guarantee.
Performance figures, charts and screenshots appearing anywhere on this website, including illustrative values in product mockups and the simulated ticker on every page, are demonstrative and not a performance record. They are not an offer, a solicitation, or a representation of results achieved by any client.
2. Software exemption & regulatory status
Atlas is a software product developed, owned, licensed and operated by EactiveNet Inc Corp. EactiveNet Inc Corp is a software company. It is not:
- a Registered Investment Advisor (RIA) under the Investment Advisers Act of 1940;
- a Commodity Trading Advisor (CTA) or Commodity Pool Operator (CPO) registered with the CFTC or a member of the National Futures Association;
- a broker-dealer registered with the SEC or a member of FINRA;
- a Futures Commission Merchant, Introducing Broker or Retail Foreign Exchange Dealer;
- a proprietary trading firm, and it neither funds accounts nor evaluates traders.
Nothing produced by Atlas or published on this website constitutes investment advice, a recommendation, an offer or a solicitation to buy or sell any financial instrument, or an opinion on the suitability of any instrument or strategy for any person. Signals, confidence scores, trade plans and refusals generated by the software are the deterministic output of a computer program applied to data you supply — they are not personalised advice and are not tailored to your circumstances.
EactiveNet Inc Corp does not take custody of client funds, does not have trading authority over any client account, and does not have discretionary authority over any client account. You configure the software. You connect it to your own brokerage or proprietary-trading relationship. You decide whether to arm autonomous execution, and you retain the ability to halt it at any time. Every order originates from your machine under your credentials, and you are solely responsible for it.
Atlas is licensed for use only where such use is lawful. It is your responsibility to determine whether automated trading and the instruments you intend to trade are permitted in your jurisdiction, and to comply with the terms of any agreement you hold with a broker or proprietary-trading firm — including rules on automation, copy trading, shared infrastructure and account sharing.
3. Licence, revocation & refund policy
3.1 Digital goods and the point of no return
Atlas is a digital good delivered instantly. A licence key is generated and displayed in your client portal the moment payment is confirmed. That generation event is delivery. Once a licence key has been generated, the purchase is non-refundable — including where the software has not been downloaded, installed or activated.
Where consumer protection law in your jurisdiction grants a statutory right of withdrawal for digital content, completing checkout constitutes your express request for immediate delivery and your acknowledgement that you thereby lose that right. Nothing in this policy purports to limit a right that cannot lawfully be limited.
3.2 Automatic revocation on failed billing
Subscription licences remain active while the subscription is in good standing. If a recurring payment fails, Stripe retries on its published schedule. When those retries are exhausted, the subscription moves to past due and every licence seat on the account is set to suspended automatically.
A suspended licence takes effect on the desktop client’s next licence heartbeat. Order routing halts; analysis and journalling continue in read-only mode; the reason recorded by the operator is displayed on screen. Settling the outstanding invoice reinstates the seat automatically on the following heartbeat.
3.3 Suspension and termination for cause
EactiveNet Inc Corp may suspend or terminate a licence, with the reason recorded in an immutable audit log, for: non-payment or chargeback; sharing, resale, sublicensing or redistribution of a licence key; circumvention or attempted circumvention of licence enforcement, hardware binding or the heartbeat mechanism; reverse engineering except to the extent that right cannot lawfully be excluded; or any other material breach of the End User Licence Agreement.
Termination for cause does not entitle you to a refund of any amount already paid. Suspension is reversible; a ban is not.
3.4 Founder Perpetual
A Founder Perpetual licence is a perpetual grant covering two machines. It includes one year of major engine updates from the date of purchase, and security and compatibility patches for as long as the product is commercially supported. Perpetual means the licence does not expire; it does not mean the product will be developed indefinitely, and it remains subject to termination for cause under §3.3.
4. End User Licence Agreement — summary
The following is a plain-language summary of the licence you accept at checkout. It is a summary; the executed agreement governs.
- You receive a non-exclusive, non-transferable, revocable licence to install and use Atlas on the number of machines your plan permits. You do not acquire ownership of the software.
- Each seat binds to one machine's hardware identifier on first activation. Hardware changes are supported through an operator-performed reset, requested from the client portal.
- You may not share, resell, sublicense, lease or redistribute a licence key, nor use one seat to service accounts belonging to persons other than yourself.
- You may not reverse engineer, decompile or disassemble the software, except where that right is granted by applicable law and cannot be excluded by agreement.
- The software is provided "as is", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
- To the maximum extent permitted by law, EactiveNet Inc Corp's aggregate liability arising out of or relating to the software is limited to the amounts you paid for the licence in the twelve months preceding the claim.
- EactiveNet Inc Corp is not liable for trading losses, missed opportunities, lost profits, failed evaluations, account failures, data loss, or any indirect, incidental, special, consequential or punitive damages, however caused.
- The agreement is governed by the laws of the State of incorporation of EactiveNet Inc Corp, without regard to conflict-of-laws principles.
5. Privacy notice
5.1 What the desktop software sends us
Atlas transmits a licence heartbeat to https://atlasquantos.com/api/v1/license/heartbeat over HTTPS. The payload is exactly: your licence key, a hardware identifier derived from the machine, and the application version. The response carries the seat’s status, its permitted connection count and, where applicable, the operator’s enforcement reason.
No trading data ever leaves your machine. Not positions, not orders, not fills, not P&L, not the instruments you trade, not your account balances, not your strategy configuration. The heartbeat has no field for any of it and our database has no column for it. Your journal, your decisions and your trade history live in a local SQLite file under your Windows user profile.
5.2 What this website stores
- Account: email address, a bcrypt hash of your password (never the password), your name if you supply one, and the timestamp and IP address of your most recent sign-in.
- Billing: a Stripe customer identifier and subscription identifier. Card numbers are handled entirely by Stripe and never reach our servers.
- Licences: your keys, their status, the bound hardware identifier, and the time, IP address and version of the last heartbeat from each seat.
- Broker credentials, if you choose to store them: the venue, an account label, the username, and the API token encrypted with AES-256-GCM. The encryption key is held in our infrastructure secret store and never in the database, so a database dump does not yield working credentials. The token is never displayed after saving and is never returned by any API.
- Audit log: administrative actions taken on your account, with the administrator's identity, IP address, the action and the recorded reason. This log is append-only and cannot be edited or deleted by anyone, including us.
5.3 Cookies
One strictly necessary cookie keeps you signed in. It is httpOnly, SameSite=Lax and Secure, and it is exempt from consent under GDPR Art. 5(3) and the ePrivacy Directive because the service you requested cannot be provided without it. Optional analytics are opt-in through the banner. We run no advertising trackers and no cross-site tracking, and we do not sell personal data to anyone under any circumstances.
5.4 Your rights and how to exercise them
Subject to applicable law, you may request access to, correction of, export of, or erasure of your personal data by writing to us from the address on your account. Deleting an account removes your profile, licences and stored broker credentials. Audit log entries are retained: they are the record of actions taken by our administrators, they are legally significant, and the table rejects deletion at the database level. Those entries are pseudonymised on account deletion — the identifying foreign key is cleared — but the action, its reason and its timestamp remain.
Licence heartbeat records are retained for 90 days and then deleted automatically.
